WHAT IS A PETROLEUM CONTRACT ?
يك قرارداد نفتی چيست ؟

Experts estimate that for a large natural resource extraction project,there will be well over 100 contacts to build, operate, and finance it- all of which could fall under the broad category of 'petroleum contract' .
There may also be well over a 100 parties involved, including:

Governments and their national oil companies (NOCs)

International oil companies (IOCs)

Private banks and public lenders

Engineering firms, drilling companies & rig operators , e.g. Halliburton, Schlumberger

Transportation, refining and trading companies
...... And many more

بر پايه براورد كارشناسان، برای يك پروژه بزرگ استخراج منابع طبيعی بيش از يكصد قرارداد جهت ساخت، بهره برداری و تامين مالی آن منعقد می گردد كه در حوزه نفت و گاز، ممكن است همگی تحت عنوان كلی ( قرارداد نفتی ) طبقه بندی گردند.

از طرفی احتمال دارد بيش از يكصد طرف در اين امر درگير شوند؛ از جمله:

دولت ها و شركتهای ملی نفت انها(NOCs)

شركتهای بين المللی نفت ( IOCs)

بانك هاي خصوصی و وام دهندگان عمومی
شركت های مهندسی، شركت های حفاری و متصديان
دكل های حفاری مانند هاليبرتون، شلمبرژه

شركت های حمل و نقل، پالايش و بازرگاني

Among these many contracts, the most important is the one between the government and the IOC.

در اين ميان، مهمترين قرارداد، قراردادی است كه ميان دولت ميزبان و شركت های بين المللی نفتی منعقد می شود.

All of the other contracts must be consistent with and depend on this contract; these might be collectively referred to as "subsidiary ", "auxiliary " or "ancillary "contracts.

ساير قراردادها بايد سازگار و وابسته به اين قرارداد باشند كه مجموعا به عنوان قراردادهای فرعی، كمكی يا جانبی مورد توجه قرار می گيرند.

This contract is most commonly referred to by the industry as a "Host Government Contract" because it is a contract between a government (on behalf of the nation and its people) and an oil company or companies( that are being hosted)

در صنعت نفت از قرارداد مزبور بيشتر با عنوان" قرارداد كشور ميزبان " ياد ميشود؛ چرا كه قراردادی است ميان يك دولت (به نمايندگی از ملت و مردم خود) و يك يا چند شركت نفتی (كه مورد ميزبانی قرار می گيرند).

It is through this contract that the host government legally grants rights to oil companies to conduct " petroleum operations ".

از طريق چنين قراردادی است كه كشور ميزبان، حقوق مربوط به اجرای عمليات نفتی را به طور قانونی به شركت های نفتی واگذار می كند.

This contract appears in countries throughout the world under many names :

Exploration & Production Agreement (E&P):
قرارداد اكتشاف و توليد

Exploration & Exploitation Contract:
قرارداد اكتشاف و بهره برداری

Concession:

License Agreement:
قرارداد ليسانس

Petroleum Sharing Agreement (PSA):
قرارداد مشاركت در نفت و گاز

Production Sharing Contract (PSA):
قرارداد مشاركت در توليد

But generally, when we use the term petroleum contract to refer solely to the "Host Government Contract ".

اما عموما هر زمان كه ما اصطلاح قرارداد نفتی را بكار می بريم، صرفا منظور "قرارداد كشور ميزبان" می باشد.
