ماده ۱۵۹
بازپرس هنگام ارجاع موضوع به کارشناس، مهلت معین را برای اعلام‏نظر وی مشخص می‏کند. در مواردی که اظهارنظر مستلزم زمان بیشتر باشد، کارشناس باید ضمن تهیه و ارسال گزارشی از اقدامات انجام‌شده، با ذکر دلیل، تقاضای تمدید مهلت کند که در ایـن صورت، بازپـرس می‌تواند برای یـک‌بار مهـلت را تـمدید کند. تمـدید مهلت به کارشناس و طرفین ابلاغ می‏گردد. ‌هرگاه کارشناس ظرف مدت معین نظر خود را به‌طور کتبی تقدیم بازپرس ننماید، کارشناس دیگری تعیین می‌شود. چنانچه قبل از انتخاب یا اخطار به کارشناس ‌دیگر نظر کارشناس به‌ بازپرس واصل شود، به‌آن ترتیب اثر می‌دهد. در هر حال بازپرس تخلف کارشناس را به مرجع صلاحیتدار اعلام می‌کند.

When referring the matter to the expert, the investigator shall specify a time limit for expressing his opinion. In cases where the statement requires more time, the expert must prepare and send a report of the actions taken, stating the reason, requesting an extension of the deadline, in which case, the investigator can extend the deadline once. The extension of the deadline will be notified to the expert and the parties. If an expert does not submit his / her opinion in writing to the investigator within a certain period, another expert will be appointed. If the expert's opinion is communicated to the investigator before the selection or notice to the other expert, it will take effect. In any case, the investigator reports the expert's violation to the competent authority
