اصل، برائت است. هرگونه اقدام محدود کننده، سالب آزادی و ورود به حریم خصوصی اشخاص جز به حکم قانون و با رعایت مقررات و تحت نظارت مقام قضائی مجاز نیست و در هر صورت این اقدامات نباید به گونه ای اعمال شود که به کرامت و حیثیت اشخاص آسیب وارد کند.
Article 4
The principle is innocence. Any restrictive action that violates the liberty and invasion of privacy of persons is not allowed except by law and in compliance with the rules and under the supervision of a judicial authority, and in any case these measures should not be applied in a way that damages the dignity of individuals.

مراجع قضائی باید با بی طرفی و استقلال کامل به اتهام انتسابی به اشخاص در کوتاه ترین مهلت ممکن، رسیدگی و تصمیم مقتضی اتخاذ نمایند و از هر اقدامی که باعث ایجاد اختلال یا طولانی شدن فرآیند دادرسی کیفری می شود، جلوگیری کنند.
Article 3
Judicial authorities must, with full impartiality and independence, deal with the charges against the persons as soon as possible, take appropriate action and prevent any action that disrupts or prolongs the criminal proceedings.

دادرسی کیفری باید مستند به قانون باشد، حقوق طرفین دعوی را تضمین کند و قواعد آن نسبت به اشخاصی که در شرایط مساوی به سبب ارتکاب جرائم مشابه تحت تعقیب قرار می گیرند، به صورت یکسان اعمال شود.
Article 2
Criminal proceedings must be based on the law, guarantee the rights of the parties to the case, and apply the same rules to persons prosecuted on equal terms for the commission of similar offenses.

آیین دادرسی کیفری مجموعه مقررات و قواعدی است که برای کشف جرم، تعقیب متهم، تحقیقات مقدماتی، میانجیگری، صلح میان طرفین، نحوه رسیدگی، صدور رای، طرق اعتراض به آراء، اجرای آراء، تعیین وظایف و اختیارات مقامات قضائی و ضابطان دادگستری و رعایت حقوق متهم، بزه دیده و جامعه وضع می شود.
Article 1
The Code of Criminal Procedure is a set of rules and regulations for the detection of a crime, prosecution of the accused, preliminary investigation, mediation, peace between the parties, procedure, issuance of verdicts, methods of appealing against verdicts, execution of verdicts, determination of duties and powers of judicial officials and judicial officers.
