ماده ۴۹۶ اگر تاجر ورشکسته پس از تصدیق قرارداد به عنوان ورشکستگی به تقلب تعقیب شده در تحت توقیف یا حبس در آید محکمه می‌تواند‌هر قسم وسایل تامینیه را که مقتضی بداند اتخاذ کند ولی به محض صدور قرار منع تعقیب یا حکم تبرئه وسائل مزبوره مرتفع می‌شود.
