هرگاه شیوه اجرای رای در دادنامه تعیین گردد، به همان ترتیب اجراء می شود و درصورت عدم تعیین شیوه اجراء، قاضی اجرای احکام کیفری مطابق مقررات قانونی، رای را اجراء می کند.
Article 498

رفع ابهام و اجمال از رای با دادگاه صادر کننده رای قطعی است، اما رفع اشکالات مربوط به اجرای رای با رعایت موازین شرعی و قانونی، با قاضی اجرای احکام کیفری است که رای زیر نظر او اجراء می‏ شود.
Article 497
Elimination of ambiguity and conciseness of the verdict is final with the court issuing the verdict, but resolving the problems related to the execution of the verdict in accordance with the Shari'a and legal standards is with the judge executing the criminal verdicts under whose supervision the verdict is executed.

تمام ضابطان دادگستری، نیروهای انتظامی و نظامی، مقامات و مستخدمان وزارتخانه‏ ها، موسسات و شرکتهای دولتی و نهادهای عمومی غیر دولتی و سازمان ها و نهادهایی که شمول قانون بر آنان مستلزم ذکر یا تصریح نام است، در حدود وظایف خود مکلفند دستور قاضی اجرای احکام کیفری را در مقام اجرای رای که مرتبط با اجرای آن است رعایت کنند. متخلف از مقررات این ماده، علاوه بر تعقیب انتظامی و اداری، به مجازات مقرر قانونی نیز محکوم می شود.
Article 496
All officers of the judiciary, law enforcement and military forces, officials and employees of ministries, governmental institutions and companies and public non-governmental organizations, and organizations and institutions whose inclusion in the law requires the mention or specification of names, are obliged within their duties. آراء کیفری به دستور و تحت نظارت قاضی اجرای احکام کیفری اجراء می شود و در مواردی که طبق قانون، اجرای رای باید توسط وزارتخانه‏ ها، موسسات و شرکتهای دولتی و نهادهای عمومی غیر دولتی و سازمانها و نهادهایی که شمول قانون بر آنان مستلزم ذکر یا تصریح نام است به عمل آید، قاضی اجرای احکام کیفری، ضمن صدور دستور اجراء و ارائه تعلیمات لازم، برچگونگی اجراء و اقدامات آنها نظارت دارد.

عملیات اجرای رای با دستور قاضی اجرای احکام کیفری شروع می شود و به هیچ وجه متوقف نمی شود، مگر در مواردی که قانون مقرر نماید.

هرگاه رای، درخصوص اشخاص متعدد صادر شده باشد و در موعد مقرر بعضی از آنان اعتراض و یا درخواست تجدید نظر یا فرجام کرده باشند، پس از گذشت مهلت اعتراض و یا تجدید نظر یا فرجام در مورد بقیه لازم الاجراء است.

هرگاه قاضی اجرای احکام کیفری، رای صادره را از لحاظ قانونی لازم الاجراء نداند، مراتب را با اطلاع دادستان به دادگاه صادر کننده رای قطعی اعلام و مطابق تصمیم دادگاه اقدام می کند.

آراء کیفری در موارد زیر پس از ابلاغ به موقع اجراء گذاشته می‏ شود:
الف- رای قطعی که دادگاه نخستین صادر می کند.
ب- رایی که در مهلت قانونی نسبت به آن واخواهی یا درخواست تجدید نظر یا فرجام نشده باشد یا درخواست تجدید نظر یا فرجام آن رد شده باشد.
پ- رایی که مرجع تجدید نظر آن را تایید یا پس از نقض رای نخستین صادر کرده باشد.
ت- رایی که به تایید مرجع فرجام رسیده باشد.
Article 490
Criminal judgments will be executed in a timely manner after timely notification:
A. The final verdict issued by the first court.
B- A decision that has not been appealed or appealed within the legal deadline or its appeal or appeal has been rejected.
A verdict approved by the appellate authority or issued after the violation of the first verdict.
D- A vote that has been approved by the appellate authority.

وظایف قاضی اجرای احکام کیفری عبارت است از:
الف- صدور دستور اجرای احکام لازم الاجرای کیفری و نظارت بر شیوه اجرای آنها
ب- نظارت بر زندان‏ ها در امور راجع به زندانیان
پ- اعلام‏ نظر درباره زندانیان واجد شرایط عفو و آزادی مشروط مطابق قوانین و مقررات
ت - اعطای مرخصی به محکومان براساس قوانین و مقررات
ث - اتخاذ تصمیم درباره محکومان سالمند، مبتلایان به بیماری های روانی و بیماریهای جسمی صعب العلاج و سایر افراد محکوم نیازمند به مراقبت و توجه ویژه، از قبیل صدور اجازه بستری برای آنها در مراکز درمانی بر اساس ضوابط و مقررات
ج- اجرای سایر وظایفی که به موجب قوانین و مقررات برای اجرای مجازات ها وضع شده یا بر عهده قاضی اجرای احکام کیفری یا ناظر زندان قرار گرفته است.
Article 489
The duties of a judge for the execution of criminal sentences are:
A- Issuing orders to execute the binding criminal sentences and supervising the manner of their execution
B- Supervising prisons in matters concerning prisoners
C- Announcing opinions on prisoners eligible for pardon and parole in accordance with laws and regulations
D) Granting leave to convicts in accordance with laws and regulations
E- Deciding on elderly convicts, patients with mental and incurable physical diseases and other convicts in need of special care and attention, such as issuing hospitalization permits for them in accordance with the rules and regulations
C- Performing other duties that have been imposed by law and regulations for the execution of punishments or have been assigned to a judge of execution of criminal sentences or a prison supervisor.
