قراردادهاي اجاره
يكي از انواع قراردادها، قرارداد اجاره (Lease / Rent) مي‌باشد. موضوع اين قرارداد ممكن است اشيا باشند و يا انسان ويا خدمات و اين كه موضوع قرارداد اجاره چه باشد، بستگي دارد به ماهيت رابطه كاري بين دو طرف. گاهي هم ممكن است موضوع قرارد هم اشيا باشد و هم انسان و هم خدمات. به طور مثال زماني كه يكي از طرفين، كشتي را با تمامي امكانات و پرسنل براي ارائه خدمات براي مدت مشخصي اجاره مي‌دهد، موضوع اجاره، هم انسان و هم اشيا و خدمات را شامل خواهد شد.
اجاره اشياء بدين صورت است كه يكي از طرفين قرارداد، مال خود را در اختيار (ژat Disposal of) شخص ديگري قرار مي‌دهد تا از آن استفاده كند و در مقابل مبلغي را به عنوان اجاره بهاء (Rental Fee) به صاحب اشياء پرداخت كند.
اجاره اشخاص نيز معمولا معطوف مي‌باشد به اجاره پرسنل ماهر و تخصصي (Skilled Workers) كه عموماً يكي از طرفين قرارداد، شركت‌هاي خصوص هستند كه به موجب قراردادي، پرسنل آموزش‌ديده و متخصص را در اختيار طرف قرارداد براي انجام امور خاصي قرار مي‌دهند و طرف قرارداد با شركت وارد قرارداد مي‌شود و هيچ گونه ارتباطي با افراد متخصص ارائه‌كننده خدمات ندارند.
نكته: تفاوت بين Lease / Rent
هرچند در اكثر موارد كابران بين اين دو واژه تفاوتي قايل نمي شوند و از اصلاح Lease استفاده مي كنند، اما بايد گفت كه Lease معطوف است به اجاره دراز مدت كه در نهايت پس از پايان آخرين اجاره بها، مستاجر، مالك مورد اجاره مي شود. به عبارت ديگر، در صورتي كه مستاجر تمامي اجاره بها را در سررسيدهاي تعيين شده پرداخت كند، اجاره بهاي پرداخت شده به عنوان قسط ثمن مورد معامله محسوب شده و در پايان مدت اجاره، مستاجر، مالك موضوع مورد اجاره مي شود: به عبارتي، عقد اجاره در چنين شرايطي تبديل مي شود به عقد بيع؛ اما در صورتي كه مستاجر از پرداخت اجاره بها خودداري كند، اجاره بهاي پرداختي به عنوان همان اجاره بها منظور شده و موجر مي تواند اقدام به فسخ قرارداد و تملك مورد اجاره كند. بر اساس عرف رايج، حداقل زمان مورد نظر براي Lease سه سال مي باشد. اما اگر اجاره فاقد شرايط فوق باشد Rent مي باشد و موجر هيچ گونه تعهدي دال بر تمليك مورد اجاره به مستاجر ندارد.
